The Royal Horticultural Society (the “RHS”) is a charity registered in England and Wales and Scotland (charity numbers 222879/SC038262) with a registered address at 80 Vincent Square, London, SW1P 2PE. References to “we”, “us” and “our” in these Terms means the RHS.

These terms and conditions apply to your use of RHS Digital Collections.

1. UNDERSTANDING THESE TERMS

  1. These terms and conditions (“Terms”) set out the terms on which any person may use the RHS Website www.RHS.org.uk to access RHS Digital Collections (“you” or “your”).
  2. By using the RHS Website to view the RHS Digital Collections you confirm that you accept these Terms and that you agree to comply with them. If you do not agree, you must not use view the RHS Digital Collections.
  3. If you use other parts of the RHS Website additional terms and conditions may apply.
  4. We reserve the right to change the RHS Website and access to or use of RHS Digital Collections at any time.
  5. You acknowledge that we cannot guarantee the availability of the RHS Website or RHS Digital Collections. We may suspend, withdraw or restrict the availability of all or any part of the RHS Website or RHS Digital Collections for commercial or operational reasons.
  6. We reserve the right to change these Terms from time to time. If we do so, we will post the revised Terms on the RHS Website and update the “Last Updated” date at the top of these Terms.

2. TERMS OF USE

    1. You can view the RHS Website and RHS Digital Collections to use Library content provided that its use is permitted by the usage terms and license indicated alongside the content:
      1. Non-commercial use with attribution permitted (CC BY-NC 4.0) - content with this license is for information purposes and/or reproduction for personal/academic use only, and not for commercial use. This license permits reusers to distribute, remix, adapt, and build upon the material in any medium or format, for non-commercial purposes only.
      2. Non-commercial use with attribution permitted, no derivatives permitted (CC BY-NC-ND 4.0) - content with this license is for information purposes and/or reproduction for personal/academic use only, and not for commercial use. This license allows reusers to copy and distribute the material in any medium or format in unadapted form and for noncommercial purposes only.
      3. Public Domain (CC0 1.0) - content with this license is available for commercial use.
    2. Herbarium content is made available for personal/academic use only, and not for commercial use.
    3. Except where indicated under the licence applying to each item, we are the owner or licensee of the copyright and any other intellectual property rights, in the content of the RHS Website and RHS Digital Collections.
    4. ‘The Royal Horticultural Society’, ‘RHS’ and our logos are our registered trademarks. You must not use these without our prior consent, unless they are part of the content you are permitted to use under this clause 2.
    5. Any reused content must acknowledge the RHS or other identified contributors, as authors of the item, as indicated in the credit lines displayed alongside the content.
    6. In the event of use of any items in breach of these Terms, we may (a) end your right to use RHS Digital Collections with immediate effect, and (b) require that you must, at our option, return or destroy copies of the items you have made. This is in addition to any other rights we may have.
    7. This site is not designed for automated data-mining. Researchers requiring large amounts of data are expected to contact us with details about their project and ways in which we can collaboratively exchange data.

3. LAWFUL USE OF THE RHS WEBSITE AND RHS DIGITAL COLLECTIONS:

  1. When you use the RHS Website and RHS Digital Collections you must not:
    1. in any way breach any applicable law or regulation;
    2. infringe the copyright, trademarks or other intellectual property rights of third parties;
    3. in any way be abusive, vulgar, obscene, unlawful, fraudulent, threatening, defamatory and/or or hateful to any person;
    4. violate the privacy or other personal rights of others; and
    5. use the RHS Website and RHS Digital Collections in a way which may harass, offend or inconvenience any person, or applauds, encourages or entices abuse, discrimination or criminal activity or in a way which is unlawful or that might bring the RHS into disrepute.

4. VIRUSES

    1. We do not guarantee that the RHS Website and RHS Digital Collections will be error free, secure or free from bugs or viruses.
    2. You are responsible for configuring your information technology, computer programmes and platform to access the RHS Website and RHS Digital Collections. You should use your own virus protection software.
    3. You must not misuse the RHS Website and RHS Digital Collections by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful.

5. PRIVACY

When you provide information to book an appointment to view any items in the collections we will process your personal data. For information about how we process your personal data please see our Privacy Policy and Cookie Policy.

6. GENERAL

  1. If we do not insist immediately that you do anything you are required to do under these Terms, or if we delay in taking steps against you for being in breach of these Terms, that does not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.
  2. We do not make any representations or warranties about the accuracy of the content in the RHS Digital Collections.
  3. We do not guarantee that your use of any content found on the RHS Website and RHS Digital Collections will not infringe any third-party copyright or other intellectual property rights.
  4. The RHS will not be liable for any direct, indirect or consequential damages relating to your use of the RHS Website or RHS Digital Collections (even if foreseeable) whether based on contract, tort or otherwise, to the fullest extent permitted by law. This includes but is not limited to liability for: loss of data or profits; interruptions or delays; or any information obtained through the RHS Website or RHS Digital Collections.
  5. These Terms, and any dispute or claim arising out of or in connection with them, are governed by the laws of England and Wales.

Reproduction rights

If you would like to reproduce images for the purpose of publication, please contact the RHS Lindley Library ([email protected]) or the Herbarium ([email protected]) with the following information provided in your email:

  • Your full name, email and address/institution
  • An outline of the research project and/or use of the images
  • Details of the planned publication in which the images are intended to be published
  • List of the images to be reproduced
  • Please also confirm that you will accept our terms and conditions as stated on this page

All permissions granted are non-exclusive, and a new application must be made for any further publication of the image.

Permission to reproduce Herbarium content is dependent on full acceptance of the following terms and conditions:

  1. The acknowledgement ‘Image © The Royal Horticultural Society’ will appear in the caption/credit line
  2. Specimens are to be cited with a URL link to the relevant page on this website, and the date [day month year] on which they were accessed
  3. Images are only to be used by the applicant in research papers and presentations, uncropped, unless specific permission has been given
  4. It is expected that the herbarium will be provided with either a copy of the publication, or a link to the online publication where our image(s) appear
